Getting married in Turkey as a foreigner, the certificate of no impediment, and how a divorce granted abroad is recognised in Turkey through tanıma or tenfiz.

Many couples with ties to Turkey come from different countries. Marrying in Turkey is possible for foreigners, and a divorce granted abroad can take effect in Turkey. Both involve paperwork that is easy to underestimate.

Marrying in Turkey

Civil marriages are performed by the municipal marriage office (evlendirme dairesi). A religious ceremony alone has no legal effect under Turkish law. Foreigners can marry each other or a Turkish citizen.

Typical documents for a foreign partner

  • Valid passport with a sworn translation of the identity page
  • Certificate of no impediment, confirming that you are free to marry
  • Birth certificate, where requested
  • Health report issued in Turkey
  • Biometric photographs
  • If previously married: divorce judgment or death certificate of the former spouse

The certificate of no impediment is usually issued by your home country's authorities or embassy. Documents from abroad must be apostilled or legalised and translated by a sworn translator. Requirements differ between offices, so ask the marriage office in advance.

Is the marriage valid at home

Whether your home country recognises a Turkish marriage depends on its own law. Many countries require the marriage to be registered with their embassy or civil registry afterwards.

Divorce granted abroad

A foreign divorce judgment does not automatically change your status in the Turkish civil registry. To have effect in Turkey it must be recognised (tanıma) or, where enforcement of parts such as maintenance or custody is needed, enforced (tenfiz).

The Turkish court generally checks, among other things

  • That the judgment is final under the law of the country where it was given
  • That the foreign court did not decide a matter exclusively for Turkish courts
  • That the judgment is not clearly against Turkish public order
  • That the other party was properly summoned and could defend themselves

For certain consensual divorces, a simplified recognition through the civil registry may be available instead of a court case. Whether it applies depends on the specific judgment.

Until recognition, a Turkish citizen may still appear as married in Turkey, which can block a new marriage or affect inheritance and property matters.
